This ain't nothing. Wait until the second wave of labor substituted EB3 applicants port their case from EB3 to EB2 or EB1 .Talk about a double whammy. Except a bigger hit in the next year or two when most of the porting succeeds.

at some point the visa numbers are going to be all used up. The lucky ones would get their GC by then and the others will have to wait for a few months.
Why worry over it? The line only gets shorter and shorter and everybody will get their turn sooner than later.
As long as they don't waste any visa numbers, there is no need for any worry. Even their random processing order does not bother me that much, because demand for EB2 will be less than supply next year. Its time for EB3 to fasten the seat belts....

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact other's basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damage or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. There is no magic wand! We could help our administrators, law makers, law protectors and law upholders to make appropriate corrections. Hence, scientific and rational dialogue through fair and just means should be our focus.
Let us highlight our difficulties in a logical way. Go about living normal life but stand up for something you believe in.

Just an observation - There always seem to be a gap of 2 months between Receipt date and Notice date.
So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?

This idea will just put another layer on the GC process. If you are going to make a rule/law to allow this 5 year EAD and new status, why not instead change the LAW to allow higher numbers of yearly GC cards or remove the country based limits.

What kind of justice would it be if your PD is current after the visas have been recaptured and you are waiting for 10 years just because your case is not being picked up in the random lottery ?

I think you have to wait until you defend your thesis. My guess
You gets Masters Degree after you finish all the requirements and that
includes your thesis defence.
Then only you are eligible for the 20000 US Advanced Degree quota
After you finsih your defence, you submit the revised doc etc for archiving and when eventhing is done the
registrar's office receives all clear signal from department and then issues you a provisional degree letter stating that
degree is granted to you (thats when you have done your degree )

What do you do now? Is this situation different. The baby situation is worse.
I have no kids yet, but it pisses me off that people here would let a child abuser get away coz it might interfere with their american dream.
Tell me. Why should someone hire a illegal nanny in the first place? Knowing the consequences, why should they come on this forum and ask for support?

Instead of allowing US STEM graduates to get GC based on US job offer it would be beneficial to instead allow US STEM graduates to apply and get H1B without any quota. Tht way they will get into the system and don't need to go back to home country. Giving GC to STEM graduates directly is wrong by law because it bypasses labour and 140 conditions which state that a company is willing to sponser GC for a person based on current market conditions.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.
