I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

I agree with this part. The moment employer knows that job offer is no longer valid, he should withdraw h1. Since he did not do that, it would work agsinst him.
Dol only understands two dates approval date and date of withdrawal.

This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..

They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.
However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.

This shows that the backlog is more than the numbers on USCIS website. People need to stop wasting time on tracking and spend time in their office work. Backlog means more business money for lawyers and trackers. IV is very small. Unless IV had hundreds of thousands of members, they cannot do lobbying like AILA or Microsoft. EB3 India and now EB3ROW is in a pitiable state. All those EB3ROW who used to be happy will now see the reality. Thank god I ported to EB2 but the dates for EB2 do not move enough. I think anyone who can should port to EB2 ASAP. This is the only solution.

Thanks for your time and effort. But I believe your time could be utilized for other better causes than monitoring the comments made by the users by using the anonymous green/red dot system.
This internet forum is already anonymous for all the posts being made. Thjere is no way someone can tie a userid to an individual. Then why a separate dotting system that ends up eating your time when someone complains?
Someone's red dot feedback is only his/her opinion of the post; the same post could result in someone else's approval via a green dot.
Just let that feedback hang out there in the open along with the reviewer's ID.
Hopefully, by keeping it in the open, it will also make one to be more responsible in their choice of language while providing feedback.
This may not be a simple change of a switch/flag. But please consider it for the future enhancements of the site.

NSC is known to create head ache for everyone. This another case of their incompetence.

They would have re-opened the case based on some evidence that became available to them after the approval or simple because they don't have work to do. I'm just speculating, in such cases they issue a NOIR requesting additional information. Can you post the NOIR? The intent is to curb H1B and greencard and NOT providing good service.

Greencard is filed for a permanent future job, you dont need a H1B to get one. If you get your EAD, you are SAFE whatever happens to your H1B as you can continue to work on EAD.
If the above is regarding your employer, beware they might start reviewing your approved I-140.
If you acquire 180 days and I-140 remain approved and you use AC21 to join another employer or if your I-485 gets approved. USCIS cannot do anything - Nada.

All that will happen in the worst case is your H1b will get revoked. You can take a couple of months vacation and come back on your approved I-131 and work on EAD till you get your greencard.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.

But the cost of collecting 5 bucks a month from 20,000 members makes this less than desirable. An yearly $60-100 membership fees is what I'd expect to pay to any organization - more if that organization is actually working to make a significant difference to my life, to resolve issues that affect me more most other stuff.
A 2-month trial-membership is more like what a business does... and may not be desirable for all the house-keeping involved in such efforts. For subscription-based content websites, this may be O.K. - but that's exactly what we're not, and shouldn't be perceived as such.

I think that should be very reasonable, and nobody would lose their sleep over parting with $5. That would easily raise about $100K per month (~20K members*$5).
However we should continue to encourage members to commit to monthly contributions if they choose to voluntarily. Also as someone suggested, different access privelages may be assigned.

In my opinion USCIS will not give inaccurate information, in writing, to a Senator. The letter clearly mentions 'Application Pending for India'...
USCIS might not have intentionally given any incorrect information. Perhaps to them what they sent means "EB applications pending for India". Key part is "for India", which quite likely does not mean chargeable to India.
I doubt if they can easily track out applications chargeable to India that easily (even if $5K is sent to them). Whatever is entered in the system when USCIS receives paper applications (e.g. name, address, date received, category, date I-140 approved, etc.) can only be used as a criteria for queries. Birth country perhaps is only on paper application, and is verified for approrpriate chargeability at adjudication time. Systems are not designed for handling cases where country of chargeability is, as is the case for us, the final stopper.
