Hmm , interesting ... I have two EB2 I-140 from the same company as well , one for March 05 (non-RIR->BEC->RIR->approved) and the other for Sep 06 (PERM) and according to my attorney my March 05 PD is applied to my 485.
I was just sitting with both hands together since my dates are not yet current, may be I should call NSC and make sure the correct PD is assigned to my case. So you just call (T/N)SC using POJ method and ask a polite IO about this if you get hold of one ? would an infopass help ?

Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
Also exluding STEM grads from quota.
Yes, I agree with all of that. It is just that 485 filing ability would do so much for so many, that I find it very attractive, especially if it can work at admin fix level

AILA has a template of a letter/email to Congress members that can be used to express support for visa recapture and immigration reform.

You may like to modify the message to suit your life situation and preferences. For example, instead of undocumented aliens, I used the opportunity to stress the difficulties of employment-based applicants. While I have nothing against them, it is my belief that I need to stress my own problem and seek a resolution.
And, I have also forwarded the link and my mail to all my friends who are waiting for green cards. More importantly, I have asked my relatives and friends, who are citizens or who have green cards, to pitch in and write for our sake.
My suggestion, should you agree with the above, is not only to write to your Congress members but also ask your relatives and friends to do likewise.

I received a sms saying that my case status has been updated (weird they sent it @ 9:25 pm PT). I was like here comes another biometrics appointment... but still let's check the status online. To my surprise and by god's grace, case status was changed to "Card/Document Production" (still cannot believe it). I dunno what triggered this but i did contact my Congressman yesterday. My wife's status has also changed to "decision" - should move to "Card production" soon.
My suggestion to all of you - please don't lose patience and do whatever you can from your end to expedite your case. It's your GC and you've to make sure you get it. Contact I/O, infopass and congressman/senator. Don't expect anything from your lawyers as they only care about money and it is in their best interest to see your case pending (more RFEs, EADs, APs, etc).
Thanks and all the best to all of you out there still waiting for your GC.

Let it be an open forum. The reason why Rajeev Khanna's Immigration Portal got so many hits before IV was that it is free.....Why we need to have paid membership when our funding drive was successful is still beyond me
I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.

The hardships we have chosen to enter united states and struggle here is of our own choice. It was an option. You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
We all have options and it depends what you choose.
Just because few centuries ago someone entered this promised land just like that, you can't expect that to be existing now or atleast a modified version of it now.
Again, i believe the immigration system can be improved only if senators can taken into confidence about our hardships. Striking the way illegal mexicans did and or raising slogans like 'immigration is a right and not a privillege' may play against us.

I called of them, took me less than 15 minutes. i am sure everyone else can call too. The selfish brats who have EAD's and are acting ignorant, remember if something goes wrong you could be stuck on EAD's for another 5- 10 years. The point is, we all as a highly skilled immigrants have an obligation to help ourselves and the ones who are stuck in this limbo till we get our GC.
You can either choose a piece of pie or take the whole cake home for your family and friends. Life is all about choices and a man is as good as his word. So give out your good word and help the others. 15 minutes that's it.

This H1b fees companies need to bother. I think 95% cases Company is sponsoring H1b.
All H1 filings which now pay a fee of $1500 or $750 will be asked to pay $10000 or $5000.....It does not apply to the H1 exempt institutions....

If you are not counted against cap, that is equivalent to visa available = PD current.
I interpret SKILL as follows for US MS.
1. You wait for your PD to become current.
2. When your PD becomes current, you are not counted against the cap.

I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV. Examples can be many like CPA, Tax preparation, Doctors, career guidance, Online tutoring, Software consutlancy. I am sure all the members are "SKILLED" in various walks of life.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.
