To Everyone...
DO NOT PANIC. These notices are usually sent when you have any H1 transfer pendings most of the time ( at least in case of H1). By law, the employer is supposed to notify USCIS whenever any employer has left the company.
The re-opening of case is a letter from USCIS to the previous employers to confirm that the employee no longer works and is usually sent to the attorney.
So chill and don't sweat.

My mistake.. I was under the impression that my contact info is visible. I have already met with my local congressman and submitted a memo. I have got a reply saying they would address this issue as part of impending CIR bill. I was not sure what to make of it, whether he is pro and anti retrogression..

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.
A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.
I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.

You claim that you received a PHD. But I seriously doubt whether the university that decorated you with a PHD evaluated your ability to think rationally and ability to reason!
Normally with education people achieve wisdom, knowledge, ability for rational thinking, ability to reason, humility, compassion and a better understanding of the functioning of the world.
I am not saying you do not have the right to complain or right to protest. You have and you definitely should have. But the approach that you have taken is the wrong one! In your post you criticize about people lamenting their plight! In reality, you are also doing the same, Am I correct?
If you are a real PHD, just go through the following post that you presented and analyze how you can improve that to make it a product from a REAL PHD!
If such an educated guy like you can become an opportunist, how you can expect higher standards from lesser mortals!
In another post you said that you were eligible for EB1 and couldn't go through that rout, are you lamenting here? If you are well qualified, why didn't you go through that rout?

So, my friend, nothing gives you a right to be here or to get GC. It is a privilege.
You need to understand one thing: Each person has different skills, living circumstances, responsibilities, and different type of blessing from the almighty. So, don't measure everyone with the same yard stick that you are using to measure and don't use your own selfmade standards.
If undocumented immigrants where also competing with you for a GC spot, you would have said, they also have the same opportunity here, why they are not taking masters and PHD to get their GCs sooner?
In reality, some are fortunate to reach your level, but not everyone! But that doesn't make them ineligible for the Pursuit of Happiness and Pursuit of a better life!
If you do have a real PHD, you should lead, you should be a role model for many and propel your energy in the positive direction instead of a stupid post like this! You can work to make things better in this country!

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

The per-country quota system is mentioned in the statues even before family or EB is discussed. Family based immigration have the per country quota too (why should an Indian Family suffer for X years, while families of other countries are able to unite sooner), but I dont see that we asked to remove the the quota completely. We only asked for removal in EB (but that is deviating from the topic).
I am not anti-immigrant, just because I argue against some provisions does not make me anti-immigrant (well the same charge will be leveled against us by CIR folks because we dont take/support their approach), and no I dont yet have my GC. I may be whatever, but I will not burn the bridge after crossing it (though I have been known to burn the bridge while I am still on it).
Yes, laws can (and shall) be changed, but can't we discuss the good and bad of what we are changing? I have seen many a legislation that have good intent at heart, but many times ends up without checks and balances (and eventually misused).

Is this situation only in Chennai consulate or in all consulates in general? I have not heard of any trouble at other consulates. I am taking an appointment this week and will choose a consulate that may work faster (Delhi or Cal).

Looks like I need to take up a priests job somewhere and file another GC in E4 category which is current. God willing, I might get GC soon.
BTW I was not expecting EB2 to move forward that much. Would be interesting to see if it moves further in next bulletin..

It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.
Absolutely. Now with PERM and premium 140, if we can file 485, and then hit the snooze button for 10 years -- no problem for me. I know, not everyone will be lucky to board onto the PERM, but atleast it will be relief for most of us.

I would strongly disagree that H1 = cheap labor. It's only the H1B employer who pays low salaries, where as the client pays the same billing rate to all contractors (including US citizens).

In my view, it is too good to be true. But we have no way to challenge the numbers either. But it is 50% of the entire EB pending cases. Is this document authentic?? I don't see the logo on the letterhead??

Irrespective of you or anybody write the right stuff, there are some or may be a lot of people who have the habit of pinpointing to anything and everything without even giving indepth thought over the logics provided and take the stuff to their ego. People wont improve and the basic mentality never changes. And then comes the band wagon. Every person things of me, myself and I, none thought of us, ours and we.

LOL .. Shows how much you are in touch with reality yourself. A website visited by misers and doubting thomases does not a good business proposition make.
I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.
I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

The company I am working with doing business for 40 years (less than 40 employee) and as per my lawyer, financially very good. I hired the lawyer and employer directly gave him financial docs. I am only one person with H-1 in this company's history and working for 4 years. Got labor approval on PERM EB2 (MS+1) and did concurrent filing with I-140 premium processing.
I received RFE regarding company's ability to pay. We sent tax files for FY 2005 (contains oct '05 to Oct '06) for being PD of Nov '06 and W2 for 2006 which showed 6k more than offered wage. Company started paying me offered wage one week after the PD and offered wage is 3k more than prevailing wage. RFE specified to show ability to pay by showing 2006 tax return or audited financial statement by 12 weeks. Any of this will not work as tax file will be prepred on Nov '07 for FY 2006 and audited finan. stat. costs a lot of money. My company has no clue and just planning to write a letter that they will not able to provide before Nov 07 and already submitted tax file upto Oct 06 which could be enough to find the financial status. They talk to their CPA and he advised to do so.
I am really not very fimilar with all these issues. What should I do as company is not able to provide above 2 things that USCIS asked for? Can I send my paychecks even started getting paid offered wage after one week?

My personal opinion is that other than few algorithm, electrical design, compiler design kind of jobs, most jobs in Computer applications can be done by an EB3/EB2 person. It's only how your company treats a particular job opening that you get designated as EB2/EB3. I could file in EB2 and lots of top-rankers from my class could only file in EB3. Does that make them any less capable than me?? Nope!
Correct. gctest is a very narrow-minded individual just like some of the phds are.
I have read many papers published by these phd students during my MS coursework. Many of them are an absolute trash!
They propose something which has bunch of shortcomings and then list them down as future work.
Others come along, look at the future work section and propose something else with one less shortcoming
and so on...
Every researcher says his/her proposal is better and runs biased set of tests to support the claims.
99% of such research papers would be used as toilet papers in India by the homeless!
Industry doesn't even look at most of this academic trash.
Most of these phds (not all) end up as lecturers making people yawn in the class.
The real productive ones that graduate from top notch universities, the cream of the crop that achieve breakthroughs don't come to this public forum and trash people around.
They are the EB1, no wonders gctest is clubbed as EB2, is he any better than any of us?
