04/05/2007: USCIS Cap Files Tally as of 04/04/2007
USCIS has just released their tally of cap filings as of 04/04/2007, Wednesday. In two days (04/02 and 04/03), they received 133,000 unique pieces of mail containing H-1B petitions, which turned out to be lower than 150,000 which they had initially reported. They reached the updated number following a physical count of the mail. Each piece of mail may contain more than one H-1B petition and it will take USCIS a substantial amount of time to open and sort through that volume of mail. It is a good news in a way that at the end, the total may turn out to be less than guestimate in the community and the rate of odds for winning in the lottery may be much more promising than the one initially anticipated in the rumors.
As of Wednesday, total they sorted out and each type of cases identified were as follows:
Total Sorted Out: 32,755
General cap cases: 28,052
U.S. Master or higher degree cases: 4,703
The USCIS promises to update report from time time as they continue to sort out the remaining packages.
It is surprising that the U.S. Master or higher degree cases are more or less higher than expected.

Name change depends on what exactly you are changing. If it is just the order of first name / last name, then you can get an endorsement in the passport.
Following is fyi based on my experience. I got my spouse's name completely changed in the US (Changed first name, last name, and removed middle name).
Before the change her passport the visa , immigration documents, SSN, Cred card, bank acct, Drivers license, etc were with maiden name and last name.
For name change in the US, I had to go to the local county court and get a name change order. This took a day in my county - may take longer depending on where you live. This court order is enough for updating all docs in the US such as SSN, Credit card, license, acct, etc.
For Indian passport, you need an affidavit and 2 newspaper clippings one in US and one in India. I placed an ad in the classifieds section of the local newspaper (costs $25 - no documents required). For Indian newspaper, I had to send these docs to the classifieds dept of the newspaper:
Local US court order copy with attestation from Indian consulate. (Gazette order is not required.)
After this I got new passport in new name.

Are you aware of State Deptt URLs that explain current immigration rules (similar to IRS rules) as following.
Someone posted a URL that requires a good choice of search words. Such a process may not get all info specially for a novice like me. Thanks.
that's right the actual law had two words that could change the actual meaning of how they are supposed to do it (ie., vertical versus horizontal). Some people (i was one of them) thought that at such a stalemate in the words that coomon sense should prevail. Common sense would dictate that skill would prevail over diversity.
However; the rules were always such that there was never any horizontal spillover but rather vertical. The main thing that changed was that the unused visas from row could be used by retrogressed countries quarterly rather then annually.

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

My GC process was started in 2001, my labor was approved in 2003 but since my company was closing the branch office where I worked, I had to move to the main office which was in a different state. Leadership-
Most of the senior members and Admins either have left IV or not able to spend enough time together to plan and organize action plans for the community. This is what I feel we are missing. We are acting alone although we are part of community.
We need to come together and keep ourselves focussed on common issues related with congress bills, retrogression, IV Agendas and road-map for coming months or years.
I mostly see pappu from core IV leadership. Where are other folks. If current leaders cannot lead us in the future, we need to find someone who could.
Again, my intention is not question anyone's hard work, but I am not seeing the same momentum and focus we had year back.

Except for those still living in denial, we know that if anyone actually "DID" anything to cause the reversal of July Visa Bulletin... it was Hon. Congresswoman Zoe Lofgren, Ms Gabriela Ptasinska who filed a lawsuit from Chicago, and Immigration Voice!
Now,
1) Calculate the amount of money YOU saved by not having to re-apply for your and your family's AOS under the new fee structure (and who knows after how many years into future?)
2) Look at the amount of money your spouse can now bring home as he/she is eligible to work with their EAD
3) Add the medical examination fees
4) Add money you would spend on photocopies/ courier charges/ driving to your lawyers office to sign the papers
The list is long, and all of it is now part of your "savings" largely due to the efforts of Immigration Voice!
And even after saving so many $$, people think $50 a month is too much to ask for?? And that too, when this is going to help bring you even closer to the one document that you think about everyday?
That sounds like "penny wise pound foolish"!
It's not too late, please sign up for monthly contributions and get active... and help IV to help you see your Green Card sooner than later.

There are various things that can be challenged. Read through this carefully
(a) Per Country Level. -
(1) Nondiscrimination. -
(A) Except as specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203, no person shall receive any preference or priority or be discriminated against in the issuance of an immigrant visa because of the person's race, sex, nationality, place of birth, or place of residence.
(B) 1/ Nothing in this paragraph shall be construed to limit the authority of the Secretary of State to determine the procedures for the processing of immigrant visa applications or the locations where such applications will be processed.
(2) Per country levels for family-sponsored and employment-based immigrants. - Subject to 1a/ paragraphs (3), (4), and (5) the total number of immigrant visas made available to natives of any single foreign state or dependent area under subsections (a) and (b) of section 203 in any fiscal year may not exceed 7 percent (in the case of a single foreign state) or 2 percent (in the case of a dependent area) of the total number of such visas made available under such subsections in that fiscal year.
(3) Exception if additional visas available. - If because of the application of paragraph (2) with respect to one or more foreign states or dependent areas, the total number of visas available under both subsections (a) and (b) of section 203 for a calendar quarter exceeds the number of qualified immigrants who otherwise may be issued such a visa, paragraph (2) shall not apply to visas made available to such states or areas during the remainder of such calendar quarter.
Department of state is allocating the annual Employment based quota of 140,000 plus some leftovers from previous years into three calendar quarters. However the law said only this about a calendar year
(3) Exception if additional visas available. - If because of the application of paragraph (2) with respect to one or more foreign states or dependent areas, the total number of visas available under both subsections (a) and (b) of section 203 for a calendar quarter exceeds the number of qualified immigrants who otherwise may be issued such a visa, paragraph (2) shall not apply to visas made available to such states or areas during the remainder of such calendar quarter.
It did not tell the Department of State to break the 140,000+ quota into three calendar quarters of 33.33% each. My argument is that on January 1st 2009 if 5000 485's are approved for EB2 there will be 46,666 - 5000 - 41,666 visas left. These visa should be given to China and India EB2 based on the above section. INA sections never mentioned nor directed Department of State to allocate the 140,000 quota into calendar years or monthly limits. It is Department of State trying to do additional favors to ROW.
There are zillions of things like this we can put in a lawsuit.

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.
Firstly, why do you care about reputation on the forums (reds)?
Secondly, did you try the process described by NolaIndia?
Here is the process as described by NolaIndian:
"The person who came up with this idea needs to PM or e-mail Pappu or Administrator and get some feedback if IV Core supports this. If you get the yay from Pappu, then form a small core group who will tacke the operational aspect of this idea and keep it moving forward. The "posts" need to be coverted to "actions". I am just speaking from experience having run a successful year long campaign with IV already. Best of Luck! "
