Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.
IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.
We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. We were also the first to break this news even before anyone else or media could, and continued to update our members as time passed.
IV also thanks its contributing members and it is because of their contributions we were able to continue this effort. Many thanks to the members that are contributing now after this good news.

Hey EndlessWait, thanks for your input and assurance. Thats what my lawyer said but he also mentioned it depends on the adjudicating officer and to keep my fingers crossed.
I dont understand the element of discretion attributed to teh adjugating officer. Isnt the 180 days a LAW? Is it possible that an application is denied if its less than 180 days and the person has reentered multiple times?

I attended the "conference in Boston" earlier this month to which three core members had flown in and had the first hand opportunity to discuss with them. The dedication and resolve they showed approaching key people in lawmakers office was just so inspirational. Specifically, the way Aman was talking to individual IV members without taking anything for granted. None of it was for individual cause but for the entire team which means "you". So the best we could do is help the group financially and provide the means to approach for more stronger lobbying efforts. Let's be real, at the end of the day, money talks in the senate ! and we all can contribute little by little and provide the backbone for us and incoming generations..so let's do it folks, please step up...all required is $20 per member...

so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?

For the record, I hold US Master's degree and am really offended by your comment and your view point.

A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.

Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.
So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh
And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. Like in the movies Rang De Basanti .. newer generation was compared to Freedom Fighters and like in Lage Raho Munna Bhai -we had Non Violence portest Heroes, I am seeing very comparble Heroes in the Immigration Voice Core team. Long time back when the british ruled India a lot of our ancestors joined their ranks and spit on fellow Indians. They were not realizing that actually the british were using them to rule effectively. That same trait has remained ever since. This is one of the greatest sin of the Indian and also many other third world cultures. They act on opportunistic thought patterns trying to gain favor whenever the opportunity arises even if it meant spitting on their own relatives. Sympathy, compasssion, honesty and integrity is often forgotten and/or purposefully suppressed for apeasement of the rulers. The feeling that you are being ruled and not in control of your own life is what really promotes such self righteous thoughts.
If you analyze this situation you will realize that there is a debate going among american citizens regarding legalizing the 11 million folks here and those favoring are in majority now. Realize then that this is a transition phase and those who dont like this to happen are trying to do as much harm as possible. causing a girl to deliver while being tied down and asking you and me to take a driving test each time you go to extend your visa are all part of this very same process. Remember that there are many many times more americans who would support, love and care for that girl than those who care/resepct/love you.

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.

Since your file is at TSC, there is an email address that AILA members have to request that your file be processed once PD is current. Contact your lawyer and ask him to check AILA InfoNet Doc. No. 08103067, that's where the procedure is outlined.
