Out of Status issues - Inconsistency with what's stamped in the passport and what you're actually doing
Unlawful Stay - Stay beyond the date in the I-94 card
The main focus will be on what these things can do to your i) AOS/CP filings ;and/or ii) future non-immigrant visas.
I came to this country because of a twist of fate and had zero knowledge of the immigration laws here. Through the school of hard knocks, I have gained considerable knowledge about this convoluted process that affects us all and hopefully what I learnt will be of use to other people in the same boat.
A special mention goes out to "unitednations" for his skill and knowledge about various issues. Thanks buddy, you're a huge asset to all of us.

This notice is in reference to form 1-539, application for Extend/Change of Nonimmigrant Status, requesting a change of status to that of a dependent of a specialty occupation worker under section 101(a)(15)(H)(i)(b) of the Immigrantion and Nationality Act.
It is ordered by the Director of the California service center, United States Citizenship and Immigration Sevices that the applicant's request for change of status be denied for the following reasons:
As a dependent, the applicant's classification is subject to the principal alien's status. The billing address is for the florist! They dont give it to the receiver! Yeah if Emilio really wants he can track you down (subpoena the florist etc etc..). But how many people will he track down? And what is he going to do? Sue you for sending him flowers? Of course that depends on what message you send along with the flowers :)

Yup. Make a group, pool the contributions. One member collects the money after making $100 pay pal, google contribution. This concept can be extended to $200 , $500 too, if you can form big enough groups.

There is a lot of work done in the background and by the state chapters that you may not be aware of. for example when i was a member of a state chapter a volunteer printed 5000 pamplets and we spent a weekend distributing them. One volunteer was actively involved in collecting and mailing out letters for the letter writing campaingn. there are some who visit every temple and talk about IV. These people dont post on the forums or beg for red, blue or green dots, they do the best they can. On the other hand many come to the forums with a 'grand plan' and hope someone else will doe the rest. Most are so self absorbed that they would rather spend time debating how their application is superior and how they should get GCs first. The same people end up volunteering each time while the rest demand answers and ask why bills are not passed. I can also give specific examples of people who posted that they participated in a campaign simply to get green dots. The final straw for me was the EB2 Vs EB3. Each person has his/her threshold, and i am positive that the core will feel the same way some day.
State chapters contribute a lot in grassroots efforts. Couple of months back, a delegation from Tri State area, Texas, North Carolina, Michigan, Massuchettes and other places went to DC and met with all our politicians - Iv arranged everything for us and we planned these visits well through state chapters - our lobbyist guided us well and also accompanied us to some meetings. Some chapters do a lot of publicity campaigns. Like for the admin fix campaign, The leader from North California (Abhijeet) took special permission from the cops and distributed flyers in train stations and got hundreds of people sign the letters.
One very dedicated member (nolaindian32) started the IV running cluib to collect donations towards lobbying
Walking_dude along with some other IV members testified in Michigan senate when MI drivers lisence issue was going on
On a regular basis IV members in DC area do meet with govt officials and have meetings, talk to media and involve in whatever ways possible.

Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?
You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.
This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.
This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?
What are we going to do with that money man? This is nothing but a greediness.
Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

I was watching CSPAN last night and both Senate majority leader and minority leader were talking about what they are planning to do in the next few weeks, Minority leader Senator Mitch McConnell talked about the Omnibus Bill and few other appropriation bills and he was hinting that they are planning on getting some of these done before Christmas. According to him, the congress does not have any other choice but to get these passed ASAP. This is the best time to attach and just ride the wave.
If we are to get anything done about our sorry state, this is it.
We need everyone to contribute.
Don�t think that IV will somehow find the money and do this on behalf of the community.
It is not the reality.
We need members to pitch in.
This is too important to ignore, I am sure if we don�t do anything now we will be regretting about the opportunity we had and how we didn�t do anything. We will not see another opportunity for at least an year.

The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.
The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.

Another member from CA has joined this challange. The member has contacted me and I have just now spoken to the member. The member wants to stay as an annonymous donor. So far he has contributed $1500 over the past few months.This member has pledged to pitch in with some more money when the total contributions from other members reach the 30,000 & 60,000 dollar mark. note that unused visa numbers from prior years do not automatically go to a specific category such as EB2/EB3/ Schedule A etc
There needs to be a legislation to recapture unused visa numbers - In 2004 a bill was passed which provided 50k additional visas for schedule A occupations (EB3)
