    A lot was said above but some basic things still need clarification.

    I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
    I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
    I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.

    These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...

    What you said was absolutely correct. However most of the times the delays caused in big companies are due to various layers of communications as well as approvals.
    I'm a live example of how i lost the opportunity to file 485 before Dec31/2004 for EB3 category, just because of unnecessary (so called) procedural delays
    NOw, this new rule in place will certainly prompt for good changes in the big companies if they truly want to sponser GC
    Yes, they must act in a timely manner. one way to do is HR should get all the necessary approvals from managers / directors so that they don't lose time. Secondly my observation is there is always a substanial delay at Attorney's office(few exceptions are there) to prepare the paperwork.



    I dont think companies are really geared to file for 140 within 45 days of labor approval.

    Most of the companies take 4-6 weeks to just send the documents the lawyers request for filing 140. Then the lawyers, most likely forget something and request more documents. It takes another 2 weeks for company to send those.

    All in all, on average I think companies need 3 months after approved labor to be ready to Fedex that 140 petition. No malicious intent on the part of employer, its just how things are. 45 days is going to make things difficult for many companies and many of the lazy, slow, procrastinating law firms.

    I looked at the pdf briefly but did not completely understand what changes are proposed for H1b in the bill.

    Below are some per my understanding. And also below are questions.

    1) Now it looks like H1b requires PERM type recruitment. Is it only for new H1bs or also for extensions & Transfers?? Most of us are already in our 7th/8th year extensions and some others are in 9th & 10th years. It will impact further extensions or transfers and will jeopardize our GC process.

    2) These changes would unnecessarily scare away genuine employers as it is like a mini- GC perm process. They may settle for an unqualified or less qualified citizen instead of hiring a highly qualified H1b suitable for the job.

    You guys are not getting it. No (in like None, Nada, zilch etc.) insurance covers pre-existing condition for visitors. If a complication arises, and you had to use the insurance, the question will be if it is a pre-existing condition or something that came up after coming here. Even if the condition comes up where an incident is not related to pre-existing condition but aggravated due to pre-existing condition, insurance will cover minimal claim amount. The odds are rigged up against you no matter what. Put yourself in the insurance companies shoes. The less you pay the more you make so you always try to deny the claim.

    Saying this, you are betteroff buying a American Insurance as hospitals over here see it as something they can count on for being paid back (though law says they have to give the topmost care irrespective of the patients ability to repay). Indian insurance is useless and will be looked down by medical personnel (some of the private pracitioners won't even accept it). Just buy some American Insurance and pray you don't have to use it.

    That is so TRUE! Ask me I finished my undergraduate from US, and I didn't get selected in the H1 lottery system 3 times, yes 3 times. Neither my wife's labor was cleared in July fiasco. So imagine my situation.


    So,
    who do I blame? US govt? Or these Desi companies who have exploited H1B system to the core, abusing the system and making our lives miserable each day. Well I am about to join an organization, which will report these Desi companies straight to Department of Commerce, there are a group of students from other Universities who are planning to be a part of the organization.

    Your question is genuine. Whom to blame ? definitely US gov for not providing enough H1B numbers.

    What makes you think the permanent employees are better qualified to get an H1 than the ones from consulting companies ?
    Generally consultants are highly competitive than the so called "permanent" employees. Many US graduates are employed due to some agreement between the universities and companies. During my consulting career, I have seen so many mediocre permanent employees who were hired just because they graduated from some XYZ US university.

    I had a colleague who was PHD in computer science from some US university. His main topic of PHD, "parrallel processing". He didn't even have a proper understanding of different POSIX thread calls which he used for his PHD. That is the value of a US degree or PHD. Your degree is only as good as you !

    I have been seeing many members talking about taking on consulting companies so that they can get better chunk of H1B visas. If you are that smart, go ahead and lobby for GC exemption for US graduates.

    I know how labors are certified for the "permanent" employees. I was called as a candidate for one of those interviews.

    Remember, if I ( the consultant) am coming down I am bringing down you ( permanent employee) with me.

    Please update us on your I-94 # after you receive your H1B Approval Notice.

    I agree that whenever you apply for Transfer/Extension USCIS issues,
    the H1B Approval (I-797 Notice) with I-94 # same as the I-94 # you have
    submitted along with your H1B Petition.


    I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.

    I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.

    Finally, I did not get any RFE.

Sure if your ideas are good and conceivable Core team would defly work on implementing it. Dont be an outsider, try to get more involved. Again if you want to be part of the Core Let Aman & Co know, they should be able to delegate you some responsibilites.

    Just like you, everybody is frustrated with the lack of progress. But we do understand our limitations, we can only educate the lawmakers with our issues, but we cant arm twist them to do something favorable. We have to keep our expectations right. As Logiclife told if big corporations like Microsoft cant achieve what they, want who are we? Does this mean we shld quit and resign our fate. Live another day, Fight another day till we achieve what we want.

    I contribute, i participate in the calls, i write to the reporters, i send faxes and emails to Senators/House Reps, Appear in Newspaper & Radio interviews and most of all Spare a Prayer to God to improve my situation.     All Gurus,

    Although we all live in the digital age, digital signatures of 20,000 people are less effective than 500 calls, and 500 calls is less effective then 50 members meeting their lawmakers in DC. Like it or not, that is how Washington works. We have to craft our methodology and adept to the ways that work in DC, and not the ways that sounds cool or most convenient. No one cares about how someone voted on IV's website or any other website, but they care when someone calls them and they keep a tally of the number of calls. For example, say if 99% of all the people voting (digitally signing) on Lou Dobbs show say that all H-1s should be sent home, do you think lawmakers care about that? Even if people provide names, and address, even then it is less effectively than 5% the number of people calling. Being an IT Analyst, one could fall into the trap of reasoning, but as we know, law is not based on logical and the process in which laws are made is also not logical. If it was based on logic and reason, we would not need Federal Affairs folks. Also, if we tell members to provide digital signatures, out of 20000 members, 200 people will give real names and data, the remaining people, the data would look something like First Name - Last Name as 'ABC' – 'DEF'. But members are more likely to feel comfortable in providing data to the lawmakers offcies. So you see, there are practical problems and considerations, although for the community that employs hi-technology for most part of their job, 'digital signature' may “sound” effective, but actually it is not.

    Just another example, we have been advised by key decision makers, counsels, advisors and our partners for not sending web-fax. Thus we are not employing that method at this time. We pay experts for this advise, guys who know what works and what doesn't, and these guys have more than decades of experience.

    We also constantly communicate with other groups and key folks at large employers some of whom we all know. We have come a long way in making these relationships to effectively run this campaign. A lot of times we are not able to disclose/explain the reason for a specific method on WWW, but before announcing and requesting members to spend their energies, we do good amount of debates and discussions with our counsel and paid strategist, which is part of the reason we pay them. In many cases we seek advice/ideas/suggestions from the top executives of the employers of some of IV members. So there is no point in this discussion. Please trust the strategy and methodology. We are high-skilled and critical ideas to conduct an effective campaign is welcome, however, we have a choice to just to be critical and do our own thing, or function as an cohesive organization acting on advise from our counsel.

    BTW, just to clarify. There was no failure. We were told 2 weeks back how it will turn out, and it did exactly the way we were told. Murray-Gregg amendment could not have survived digital signatures of 20 million people. And we were told so by our counsel. But we were advised to continue to make those phone calls because these calls are counted and will have its effect for the next time. Trust us, our strategist is “The Best” one could hire in DC. Each such effort is an opportunity to gather more support to convince few more lawmaker. It is one step at a time. It is not an easy process, but the one that works. There are no shot cuts to the process of changing the law in the politically charged environment about immigration subject.

    The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.

    On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

    Thoughts?

    One more thing. Working on EAD can be preferred to both categories, ppl who has consumed all 6 years and ppl who haven't yet.

    1. If you have consumed all 6 years, according to above link, can file MTR if 485 is wrongly denied due to AC21. EAD remains valid till atleast the appeal period. while if they are on H1 extension beyond 6 years, H1 is cancelled with immediate effect.

    2. PPL who haven't consumed 6 years have an added advantage to come back to H1 and guess what, he can (if needed) start a new GC process while retaining his older PD (as his 140 was once approved, he retains that PD for life).

    I found this by extremely intense research on internet, CIS website and many well-known lawyers forums, chats and discussion. However it is always advisable to consult your own attorney.

    68K is unbelievable. Can you elaborate how.

    The pain during the long wait is understandable.

    Since you asked here goes........Yepp 68K. Let me say at the outset, that was both my share and my employers share(mostly mine however probably 2/3). Nonetheless all of these were USCIS/Lawyer/Related process fees.

    3 separate J1 visa fees. Filing fees etc. About 1K.

    Lawyer J1 waiver representation fees 7k. USCIS fees for that filing process plus getting the State sponsorship for the program etc. another 1K.

    Lawyer gave bad advise(told me filing labor won't help me as NIW takes the same time, never knew about something called PD in those days nor did she tell me). That screwed my case so when I found this is not correct and she continued to give bad advise, I changed lawyer in late 2003. Ended up filing both ways.



    Then the 6 H1b filings. (My wife changed jobs on H1b and also had two renewals, I had one renewal). Lawyers fees 1800-2000 each time, plus USCIS filing fees. We did premium processing for H1b on three of those occasions, so 3K more.

    Next the retainer fees for Each of the four 140s. One of mine based on Labor, and one NIW based were 6 and 6.5K respectively. My Wife's were 5K and 6K(both Labor/PERM based with but with different employers). The Adverts etc were separate. The four USCIS filing fees for this. We also did PP for two of the 140s, so another 2K there. Then the 485 filing fees. Also, we were finger printed multiple times.

    Then our near annual ritual of EAD/AP application for the past 4 yrs(though it felt more like semi-annual). Lawyer fees 1K each rounds, USCIS filing fees plus minor charges about $1300 each rounds(cumulative two EADS and two APs). Only to have it valid for 9 months because you applied on time and they approved it too quickly and they approve it just for a year from the approval date eating up 3 months of your old one. Only on my last application in March did I get a 2 yr approval. Apply later you say, well once I applied just 95 days ahead and was delayed as they took 126 days, they sent an RFE(after I inquired after 90 days mind you). It got so bad that due to that RFE and the delay for my EAD, mine and my wife's cases were even out of sync, heck even my EAD and AP were out of sync(my AP was approved but they had a RFE for my EAD as I said before)............hence more courier fees and more confusion!

    Total of 8 passport stampings over the years..... another 1K.

    I had to do medicals twice, Get CXrays twice, PPDs once, Labs twice, because the civil surgeon screwed up the form the first time and the USCIS advised me about this 3 yrs later, rendering everything done previously obsolete and so..........second rounds. The civil surgeon even charged me twice! SOB........ but I digress.
    My wifes medicals were just once, fortunately went through fine. Total 2k for all the above back and forth for mine and hers.

    Then other miscellaneous fees, Lawyer document fees, Courier charges, RFE responses etc.

    Now I will spend the last 150 on a bottle of Dom Perignon and hopefully that will be the end of this saga!


    You can tally it up for yourself. That is the ball park. Each person can quibble a few thousand this way or the other based on what you consider attributable to this endeavor or not. However, that was the tally I made. Either way it is shameful and extortionate IMHO.

    I work for a medium sized (employing about 500 employees in USA, another 2000 ouside USA), public (New York Stock Exchange) listed, business technology consulting company, which has been making losses for last 3 years. My I-140 was filed last month. Do I have to start worrying?
