    Looking at discussion going on here, its sure that IV have financial problems & only 5% (of total 8000 members) are contributing for the cause. Now, if we restrict IV website for "paid" visits, dont you think that IV membership is reduced by 95% to only 400 paying members?

    Instead of making "Paid" web site, I think Moderators needs to delete derogatory posts & block such userids.

    That is not a good option that would stop/reduce new members significatly, when IV goes to DC to represent our self, we have to say ' we are only 400 members ' There will be lot of difference in infuence factor when we are saying we are 400 to 8000

    I feel education should be rewarded (Every where). High skilled should get prefference.

    For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!

    I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.

    Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.

    THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.

    Seriously, how much more immature can we get?

    Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.

    We have seen that even after the PD being current, there have been many people whose cases have not been approved. We saw last year in July many cases with later priority date and later receipt dates were approved and people with earlier PD and earlier Receipt dates still waiting,

    Now with the 180 day rule for FBI name check, things could be expected to be little better, but we have to remember that since most of the cases are paper based, some one has to physically get to cases from a huge storage, sort it manually, distribute it manually and get it adjudicated.

    So even if the visa number is current, just beacuse the number of applications are so high that we still cannot say for sure whose cases are going to be approved.

    From www.immigration-information.com, it appears, the biggest factor in getting the GC visa number allocated to a case is, having a case ready to be adjudicated and in the hands of an immigration officer at a time, when both processing date and priority dates are current. It appears that even after the huge retrogression, there were not enough demand for AOS based approvals, so they had to PD current to allow CP based cases to use the visas and ensure they are not wasted. I like the fact that visa were at least not wasted, but I would have loved to see applicants who have been waiting for years to have a first opportunity to that visa, specially because they have done everything that any one could do.

    I have been pro-fee increase by USCIS, only provided that they will use this money to expedite the processing, make things eletronic, make things more transparent, and to be honest, I feel the overall improvements are happening. Though I still see a lot of scope for futher improvements.

    We have clearly seen that labor processing has been improved dramatically with PERM. Now waiting for years to get Labor is almost history. I hope that IV and all its members direct its efforts towards ensuring that we see the improvements in efficiency that we expected to happen with fee increases.

    Lets unite together to work for a system which is fair and efficient for everyone. Lets contribute to IV administrative fixes and any other efforts which will ensure a higher efficiency and better utilization of visa numbers for AOS applications.

    I would like to take this opportunity to ask all the smart and creative people here to put some effort and find out what real steps could be taken
    Like
    - Identify what was expected from the fees increases like
    =>more information online about the case status.
    => Some tracking on how much backlog is reduced each month
    => come up with a trend of how much time it would take to complete the backlog.
    => Use the statistics, to keep the pressure on the agencies, to improve effencies.
    - Verify that those steps (which needed fee increase) have actually taken place
    - Maintain Statistics to show how successful Fee Increase was ....
    - Ask for multi year EAD/AP
    - Ensure, that once a higher fees is paid for EAD/AP, every one should be treated equally(as in all other renewals should be free)

    Keep coming up with what all needs to be done. How we could track it. How could we maintain statistics which would put the needed pressure on agencies which need to improve....

    Again I would encourage to come with ideas which will unite the legal immigrants togther and be fair to every one instead of ideas that will divide us and help one group at the cost of other.

    We all deserve to get cases processed in a reasonable time. SO lets put ideas together....................

    A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)

    I agree. On an average, it seems, one spends just about 6 yrs to get his/her GC. That's nearly 20% of our productive "employment" life. At some point in the process, one starts to wonder if he/she can lay their roots in this country.
    It is not an easy or trivial task to "just move on" and pursue plan B or plan C.
    With passage of time, the priorities and the drive of people change.
    So, the immigration system should be quick and transparent.
    If you notice in daily life, there is always a "good-faith" disclosure of terms and conditions before signing up for anything. And both parties strive to keep their end of the deal.
    That's all we are really asking from the SYSTEM - "If you are willing to open the gates for immigrants, please process their applications to the best extent possible and don't hold up our lives"

    What is missing in this system is "empathy". Rules are fine and we also understand the over-subscription in certain categories. But at the end of day, the controlling or executive authorities have to show some empathy to those that are left hanging. Rules are made to help people and they should not become an excuse to punish [PR process delayed is justice denied, truly] the common folks instead.

    President Obama has stated he would like have an empathetic judge on the supreme court. Likewise, we need someone heading the immigration system that empathizes with the lives of prospective PR lot.

    What can we do to seek such a leader or change?

    Are you asking to show courage from him? Hmmm in previous post he claimed to have the courage to ask these stupid questions but he was anonymous.

    Anonymous persons are not qualified to talk anything about courage. If you(anands26) are so courageous, then why dont you unveil your identity.

    Look at his post several months back. He had full faith in IV as a free rider visitor. He believed something will get passed due to some chunk of insane contributors. When his beleif of free riding ended up in failure as feb 15th is nearing, he bursted himself.

    Show some Courage Dude. Take up a role in your state chapter, go meet the lawmaker, Educate them on the difficulties we face, write to the reporters & highlight our issues. Contact the Core and ask for responsibilities. I am sure the Core would be happy to delegate some of the responsibilities to you.

    Why dont you do all of this, before criticizing everyone who is involved in the noble effort?

    My post is going to make few MS/Phd people angry over here. Correct me if I am wrong, but when you came here to do MS/Phd, you came on a student visa...Right? Student visa comes under Non Permanent Non Resident alien category. All of you had a burden to prove to the US consulate that after you complete your degree, you would go back to your home country. All of you prepared for that and you knew the moment you said, I might not come back, F1 would be gone! You said this...every time you went back for F1 visa revalidation. Mind you..that H1/H4 never had that burden. They could have easily said that yes, if I like USA, I might not come back.
    Now fast forward....MS/Phd is done. Suddenly...."I will go home after MS/Phd" statement is gone..and hunt for H1-B is on! Once they get H1-B, hunt for Green Card starts. Once this heavy head Phd guy, who spent last 5 years on 1500 bucks a month is in GC line....he also realizes that hey, H1-Bs should not be allowed to interfile. After all, they all work for desi consulting companies. Yeah..right! Look who is talking! All H1s should come in EB-3, after all they did not go through 1500 bucks a month for 5 years.
    Here comes a Phd guy who always lied to the system saying "I love my home country, my research would do wonders to the society at home" is not leaving any stone unturned to get his GC (faster than anyone else).....tell me, who is inferior? A Phd student who lied to the system for 4/5 years and suddenly changed his intent or an H1-B candidate who never had the burden to prove that he would go back.

    All of us are part of this very painful journey! I have spent 8 years on H1-B and I am still waiting for my GC. I work for a desi consulting company, my GC is in EB-3, I have a B.Tech. degree from IIT and I am sick and tired of this GC mess.

    If the visitor develops some symptom, it could be because of some condition that originated in his/her country and the symptoms showed up now. Note that in this case the insurance will treat it as a pre-existing condition and the claims will be denied.

    Remember that insurance companies make the determination only after a claim is made and not before the visitor is taken to a doctor. So please be aware of all scenarios before buying an insurance.

    My suggestion is to get a medical checkup done in the home country for any hidden condition, get it treated if you are buying just an emergency insurance or declare the condition and buy an insurance that covers pre-existing case. Be aware that depending on the condition the premium could be high or if the condition requires treatment the insurance could be denied..

    I submitted usps money orders for I-485 fees. Filed on july 2nd.

    Any way to find out if those money orders are enchashed or no?
    I did try google search and so far no answer.

    I am not aware of anyway to check if money order is enchased or not, because, I think, you have to pay money upfront when you buy money order. However, I can be wrong.

    If you can porting to EB2 is always a better choice.
    For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.

    HR 5882 is the only solution for all atleast for this year.
