Lets not support this bill guys. The right way to stop mis-use of H1 or L1 by companies is to make it a free market for the "employees" in visa. Let them be able to work for "any employer". Do you think the L1 guy will let him be abused, if he was allowed to change employers easily. Lets not close the doors for others, lets have an open mind to for competition and equal human treatment. Also lets see what is best for USA.
Putting more restrictions on employer is never effective. Abusing employers will always find the loopholes, and the legitimate employers will be scared away. The effective way is to get the "visa employees" more freedom.

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

wage were $53000 per year.
Join the company actually in 2002
There was a company change change with same dba xyz ... in year 2001,(means employer close the company and open another one with different name at same location)
Same Owner and same business location so company file two taxes for company 1 and company 2
Company 1 2001 tax return shows net income of $25,500
Company 2 2001 tax returnshows net income of $28,300
company bank account also shows over 100k in 2001
I call my attorney already and did not hear back from him yet on this issue
Can my attorney submit both tax return and claim one is the succsseror company(means employer took all acids, inventory and liability of old company of all the company) and presented to RFE office and
is it very complecated case or simple case ?

But if he gets his way and H1 blackout anyway (if not in the first day then soon due to pre-existing demand from 2/3 of the applicants who lost the lottery last year), then he looks like a total a**!!

Have to watch this one carefully. Kennedy (one of the co-sponsors of this bill) had thrown EB immigrants under the bus last year while favoring FB and illegals (in CIR). Need to be see the contents of this bill very carefully. Esp this clause from the AILA report:
"Addressing the decades-long backlogs for certain countries by raising the per-country immigration limits from 7 percent to 10 percent of total admission".
The CIR in 2007 had a similar clause, bumping up the country-limit from 7% to 10%, BUT it had another related clause that stopped rollover of visa's in the last quarter.
That would be disastrous for people from India and China as number of visas issued for the whole year will go DOWN!!
The recapture clause sounds promising , provided there is atleast an even split between EB and FB (of EB coming before FB). If they do it the other way around (like they had done in the last recapture for schedule-A nurses) then EB people will see no benefit of the recapture, and will end up losing one more quick-fix option.
Eagerly waiting for the bill text so the dissection and analysis can begin!!

I am working on EAD for company B. Company B filed H1 transfer for me before May 2007. I heard that You can transfer you H1 and EAD both with new company but I did not aware about this rule, I started working on EAD. Is it possible to go back on H1 which company B filed? I have not yet used AP for travelling abroad.
