    I applaud you for starting this effort but the petition needs correction, You are calling Lou Dobbs of lying but all the instances you quote are from Sen Tancredo . You may accuse Lou Dobbs of supporting these lies by letting them stand unchallenged not correcting them.

    When we fight we should get our facts straight so that no one can point a finger at us.

    I am saying all this at the risk of being ridiculed and abused by some of you. But before you do read the petition again and read my statement with cool head.

    Victory will come to those who are righteous not impetuous

    We need to document all the inaccuracies floating around and patiently with the backing of facts dismantle each and every one of them.

    I partly agree with what you are saying. Agreed that we need to document each and every misconception on H1-Bs that Lou Dobbs has propagated on his show. However this petition is about that one particular show. We need to make a beginning somewhere. Lou Dobbs must be held responsible for the veracity of the content aired on his show.
    You are welcome to start a new petition highlighting other issues.

    Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.

    I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. It has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..

    Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..

    16 hrs and no green card is too much pain. Kudos to you for being so patient. Have you considered applying in EB2?
    With your experience you can change your job and use it to get Eb2


    all those EB3 guys out there waiting for so long you should think about porting to EB2. All the information is on line, lot of discussion has happened, most of the people know the process.. so be proactive rather than examining patience. last thing i would like to see is some EB3 guy comes in and ask for some IV initiative to stream line porting :)

    With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV). The more obvious things that can be found for example in USCIS handbook (http://www.uscis.gov/files/nativedocuments/M-618.pdf) are not included here. Below is a snapshot of what I have gleaned from Internet so far, and please add your own input(s):

    LIST of DO's :

    1. Carry the original PR card on your person at all times (e.g. in your wallet), keep photocopies in different places, and also store A# on your computers. Note: This is a contentious issue (do a google on "carry green card" and see for yourself), despite being required by law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Some people are naturally worried about losing wallet and the eventual hassle of replacing the lost card (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=b3f7ab0a43b5d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD), whereas others, including me, prefer to follow the law, in case I am suddenly asked to produce evidence of my legal status (e.g. in some border states, or unforeseen events, such as being involved in an out-of-state car accident where showing my DL might just not be enough). Failure to comply may result in, at best a fine, and at worst detention for breaking a law. (See comments by InTheMoment below for additional perspectives.)

    2. Retain all original copies of USCIS documents related to your legal status during the entire period of stay in USA, and shred all photocopies (except when you have a photocopy but not its original).

    3. Retain all employment-related documents, particularly original copies of appointment letters.

    4. Retain copies of all tax return forms from the year of your first entry, or (at least) previous 10 years (you can request IRS (http://www.irs.gov/pub/irs-pdf/f4506.pdf), or your professional tax preparer, for any missing copy).

    5. Maintain a detailed log of USA exit/entry, including dates, POE and countries traveled, beginning with the day of first entry.

    6. Maintain a detailed list of all legal troubles, including minor traffic infractions such as speeding violations (ignore parking violations, because they do not constitute legal "detention"), going as far back as possible. Keep copies of all relevant court papers, traffic tickets, proof of any payment (e.g. scanned copies of personal checks used, credit card statements), and so on.

    7. Update your social security card (http://www.ssa.gov/online/ss-5.html) to remove any restrictive clause about work authorization printed on it. Note: AFAIK, the procedure changes nothing as far as your privileges go, and some of you may not even have such a clause on your SS card (I don't have it either).

    8. Return your I-94 cards to POE on your next trip outside USA, to "close the open files" on your past travels (I do not know what it means though). Note: AFAIK, this is also not required, and besides, you should have the chance to do this while applying for citizenship.

    9. Renew DL to get rid of the annoying "Temporary" word (in case you are in one of those states that do this).

    10. Update your status with your employer by filing new I-9 form (thanks to InTheMoment for this point).

    11. Continue to notify USCIS (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=c1a94154d7b3d010VgnVCM10000048f3d6a1RCR D) about change of address within 10 days of moving, as before (thanks to seahawks for this point).

    12. Keep a list of current and past residential addresses, including dates of stay. Retain all leases/ownership documents.

    13. Remember the basics: Initiate your GC/passport renewal process at least 6 months before expiry/Intl travel (Thanks to pappu for this point.)

    14. And yes, move the family first commitment at the top of your must-do list, now that you have less worry about re-entry, and make that long-delayed trip home to see your old folks one more time. (I am visiting my 83-yr old Dad, who still has more hair than I do, and less gray too, in June.)

    LIST of DONOT's :

    1. Do not sign up for voter registration card. In particular, never vote in national/state/local elections that are open only to citizens, because this is also a law (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD). Even an accidental mistake (e.g. voting out of ignorance) is a serious offense, which would not only derail your future citizenship plan, but may even result in deportation.

    2. Do not develop a pattern of frequent and/or long absences from USA, unless you have taken prior permission for valid reasons (e.g., studying abroad, medical emergencies etc). Otherwise you may face trouble at POE on your next re-entry attempt, because DHS has become stricter in recent times about possible misuse of PR status, and POE folks are now trained to spot such patterns.

    3. Do not switch job soon after getting GC. This is one of the most discussed, but least understood, issues because no one seems to agree on "how soon is soon". The rule of thumb appears to be "6 months", and a safer bet is "1 year" (here is a thread (http://forums.immigration.com/showthread.php?t=154533) on another forum). This again relates to USCIS being increasingly sensitive to possible misuse of PR status, and this question will come up during your citizenship application process. (But, as InTheMoment points out below, the issue becomes moot if you invoke AC21.)

    4. Those of us who self-sponsored our GC via NIW or EB1A route are not bound by such employer-employee commitment, but you should continue working in "similar areas of expertise" that you claimed in your NIW/EB1A petition, and preferably on a longer time scale.

    [This is an evolving list thanks to valuable inputs from folks here and elsewhere, so keep checking back.]

    Good post I like it and I probably may follow most of these eventually but, if I think about it, it seems to me lot of stress. Maintaining records from past ten (GC)/fifteen (Citizenship) years is certainly a stressful activity. Except education certificates I never cared for anything in my home country. In spite of taking care of all this, if you get involved in an unfortunate event everything GC/Citizenship goes into vain and back to square one.

    I am not trying to discourage or depress any one. It�s just a thought.

    We can always convey that the amounts can and will be adjusted based on need. But let's set a target. Disclose the goals. Not the exact dates and times and the kinds of meetings being attended nor do we need a detailed daily report of how the money will be spent. That is micro reporting and I think we all trust IV enough to know that the money is being well spent. All targeted funding drives help us do is plan better and focus better.

    Let's be vigilant and worry about the things we can worry about.

    Getting a little philosophical:
    I agree with you that the outside world is cruel. But the journey's been alright till now hasn't it. I was a huge supporter of the Gandhigiri campaign and was one of the primary reasons why I got involved with IV in the first place and am proud of it. We need more voices and more participation.

    See how he opened up a thread and threw a match to light the fire so that everyone starts fighting amongst themselves and he did not post again in his own thread .

    I totally support banishing country quota. It is totally unfair specially to folks from India/China/Mexico and others (in EB category).

    However if we analyze the current mess. Following are some of the things that led to it
    First of all 65K is the number of H1-B's that are issued every year. Lets assume all of 65K applies for GC >> then we get 65 K * 2.2 (dependents) = 143K GC's.

    Then how come we have such a big backlog.

    1. H1b visa ceiling was increased to 195K during the tech boom of 2000's but they never increased the EB based green card (it remained 140K)

    2. Wastage of EB visa by USCIS. Some estimates are in range of 500K. But let's say they wasted half of it (250K). This should be sufficient to clear the backlog.

    3. Third of last few years with rise in economies of India and china and ROW, we have seen an increase in the L1's (globalization). I totally agree with this and have no issues with L1's. And many of L1's decide to stay in US. And of course GC comes from EB category.

    Simple logic is H1-B non-immigrant visa has been recognized as dual intent, which means holders of H1B can legally apply for GC.
    On the other hand Congress and US govt have failed to provide adequate GC for EB. The system is a total chaos now for all the above reasons.

    This is what we need to communicate to congress/us govt and if required challenge in court.

    I am married too, but i only said that there are other easier paths aswell.

    Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
    As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.

    I disagree with Logiclife on immigration to the U.S( or to any other country for that matter) being a right. All that would have made sense when the "new world" was discovered and does not hold any water in today's context.
    Also, we get paid for getting the job done not working hard. So just a claim of being the most hardworking "class" of prospective immigrants will not cut it.

The conversion rate you get via this method matches with the current rate and you would loose nothng. However, you can only withdraw upto 25 thousand rupees per day.

    ICICI deliberately delays the money transfer so that they can pick a day with lowest conversaion rate. Again the conversion rate they display on their site is off by almost a rupee from the live conversion rate.

    All banks are well protected from laws and you can't do anything about it.

    Credibility is lost if dissenting views are deleted. Let's agree to disagree AMICABLY.

    Let's agree to disagree- I am very uncomfortable with the attacks on those who share dissenting views or who attack IV core team etc. Let's not forget that we're a democracy and thus entitled to share dissenting views - it is actually healthy.

    On the other hand, at the end of a slugfest, we should make some progress. I have not seen any progress in all slugfests. My previous post has an example.

    In my own very narrow/assinine/conceted/... way, progress is contributing to IV. Hence, I am focussed on progress in following.

    Core is negotiating with a lobbying firm. I understand that QGA was paid 60K.

    1. Where is the money for the lobbying firm?
    2. Whose problem is it to arrange money for the lobbying firm?
    3. How does discussing any issue in the forums help us in arranging money for the lobbying firm?

    Good thoughts. I also agree it will be a small change in code.

    Discrimination on the line of payments will only lead to more mess....and more complaints...in the end people with common problem distance from each other. We all are in this together...we must solve it together including those that did not contribute a penny so far. All we can do is to convince those people to donate for the cause. You know our folks are not the best ...when it comes to donations:).(Not the religious)

    It's just that some contribute more and some less...and there are some like IV core who contribute a lot more than others. Just the shear number of 25000 is a strength to IV...I agree that it may be only 100 who actually dedicate themselves to the cause. Decreasing the number would only mean...leaving some of our own people back.

    On the same line of thoughts as yours...I think it is ok to ask the user/questioner if they would like to voluntarily donate couple of bucks...if they think the answer they got is valuable enough and if it served their purpose. On the same note as the user posts a question....depending upon the urgency and the importance of the question...user could have an option to put a 'Value' of donation that they would make if that question gets answered soon enough.

    While denial is beautiful, stupidity is frustating, isn't it?

    I realize that there is no point in telling you guys anything. When you don't have an open mind, you can not accept the facts. It's like banging your heads against steel wall. When you are not even ready to diagnose the disease, there is little hope you will be able to cure it. Denial is a beautiful thing.
