    I know you are a committed member and you contribute as well. You have been helping the holiday thread to be on the top too. I was talking about my IV holiday fund raising to one of my co-worker who is a US citizen and who does not have an Indian/ Asian ethnic background and he had mentioned to me you guys are 25,000 people and all of you are hard working legal immigrants. you dont need to go to anyone else for money. your group is financially very strong. If all of you put in 10$ each month you will have 250K funds available every month. What you should really work on is get every member to commit to that 10$ every month. What can we do to get every one of us put in that 10$ every month?

    I have read my post couple of times before posting to avoid any mis-communication...but it's never possible to prevent I believe:)

    I have a recurring contributions setup and also contributed what ever I could this holidays...probably will contribute more before the end of the season. My post is not about the Monthly contributions made by you, me or many others...who signed up.

    It's about the ones' who cannot for what ever the reason may be....you and me pointing to the salaries or house-hold incomes will not help them join the wagon.

    It's about increasing the donations irrespective of people joining the monthly-contributions scheme....Other viable options...may be having a IV donation boxes...in immigrant owned businesses....etc.

    In an ideal world as you mentioned atleast 20000 of 25000 will contribute monthly....It's defintely good to aim for that....but that's not realistic.

    eb3chinese.org was the site created. But of the info is in Chinese.

    I had gone through their presentation sometime back and they were basically complaining about how EB india gets most of the spillover and they don't (along with some common arguments about visa recapture, FIFO etc etc.) You should be able to get details from their class action doc against USCIS uploaded on the site.
    when news of this class action lawsuit initially came out, lots of folks on IV were mad at why we were not joining in and that we should launch a barrage of lawsuits against USCIS as well. IV core at that time calmly explained that lawsuit options have been explored and will not be viable but few people listened.
    Anyway a recent update on this forum shared that they lost the lawsuit. So on hindsight we saved ourself lot of time, effort and money.

    Hey Bel -

    Quite honestly I think the best value from an MBA is derived from the timing, i.e. where one is in his / her career. I had a B Com (Accounting) from University of Sydney, an American CPA, combined with 10 years of work experience whilst enrolling for the MBA. I knew ahead, the curriculum wasn't going to bring added technical knowledge, however, it did bring some new ways of approaching the business community. Having the opportunity to sit in a class room and share / hear experiences from some of the successful executives does broaden the thought process. The program also helps build / expand the network. Again, I didn't feel I learnt something groundbreaking on the technical aspects of accounting / financial analysis, or the everyday business etc, but I wouldn't say it was completely useless. Plus for some reason, the "tag" does help.

    BTW, I'm not sure the background of those who provided you feedback. My sentiments are shared at least by 3 good friends. One is a Wharton Alum and the other two, from University of Toronto. All of whom had at least 14 years of work experience, and were Canadian Chartered Accountants at the time of enrollment. The feedback could vary depending on the backgrounds.

    May be that is the reason you took offense when people commented on Bcom thing. An MBA is valuable only if your bachelors degree is valuable. Many people have this wrong notion that it does not matter what you have in your bachelors, if you get an MBA everything is all set. Companies need engineer + MBA combination. Very few companies hire MBAs for accounting work. DOn't confuse accounting with finance, they are different. I can tell you that for sure, as i work in finance.

    Contents of MBA also matter, most people take easy way out by taking all bluff management, marketing and strategy courses. Very few take the hardcore finance courses such as derivatives, fixed income, and valuations (these courses could differ in level of difficulty based on school).

    Most immigrants apply for citizenship in developed countries for the sheer luxury of visa free travel to most countries and to bring their spouse/families closer to them without any immigration hassles. It has got nothing to do with renouncing all the ties with their home countries.

    I know a friend who recently became a Canadian citizen and he said that he was murmuring a Hindi film song when the Canadian national anthem was played during the oath ceremony. The only reason he immigrated to Canada was to get a Canadian passport so that he can work in US and travel around the world without visa hassles.

    I also have a friend who�s a US citizen and he was able to get his newly wed wife into US in 3 months. He visits India regularly to take care of his property investments, watches cricket/desi movies, loves eating food at the road side eateries and by all means he�s still an Indian at heart.

    Citizenship is like getting an unlimited credit our existing credit card (GC). The more the limit the more flexibility we get. So let�s avoid bringing patriotic fervor into such posts.

    I like your response, really -- I think it's frank and hits upon what it means to be Indian at heart.

    BUT, when one makes a decision to immigrate - he/she's not just making that decision for himself - but also for his/her spawns and the future generations to come. Is it fair for us to rob them of (well, i know most american born desi kids don't care a rats ass about going/being in India) - what it feels to be an Indian at Heart? what it 'Really' feels like to be watching/talking cricket/movies on 'em gullies, what it's like to be eating gaadi chaat, what a festival should really feel/look like .. and a bunch of other stuff- -that happens only in India.

    not trying to discount anyone's opinions .. it's just the internal dilemma that needs addressing

    Good to know...good job guys...

    Just got back from the rally, i would say it was a big success. Media coverage on the issue was fantastic. I saw the ABC7 news truck. There were many reporters from SJ Mercury news, SF Chronicle etc. Crowd was good, dont want to speculate on numbers yet but we should have an official word soon.

    Police were very friendly. The crowd was very enthusiastic and also obeyed the rules. All of us stayed on side walks. Logiclife and Frankilin among others were there. Many reporters spread out and spoke to people.

    Lot of members from another groups called Immigration Rights also joined us.

    We got lot of honks. !!!!!!!!!!!!!!!!!!!!!!!!!1

    It would be nice to have people donate and list down skills that they would be willing to contribute.

    I am not sure if its legal or not but various members can contribute their skills in exchange of donation to IV. This way members with skills are giving their time to IV and Members of the forum are getting sound advice/guidance/service for small contribution to IV. Examples can be many like CPA, Tax preparation, Doctors, career guidance, Online tutoring, Software consutlancy. I am sure all the members are "SKILLED" in various walks of life.

    There have been thousands of instances where applicants have been disqualified from applying for GC and even their H1B revoked when initial degree was found to not be related to the occupation - examples: B.Com, B.Sc (Bio, Geology..except Physics/Math), B.Arch.
    USCIS is now very strict. :( -but for the betterment of the whole system.

    It goes by how requirements were specified on LC. If you put proper wordings on LC B.Com, B.Sc. are OK for EB3 .
    But for EB2 they want Four year degree for Indian graduates.

    Yes, that is right, I said �plight of EB2-India�.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as �oh..i am a poor EB3 waiting for n number of years� etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to �my career is over because my gc is delayed� are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven�t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

    Lets move on and focus on this main topic...

    Here are my observations.. Correct me if I am wrong..

    1. L1 option for IT is essentially killed

    2. Small IT companies will limit the headcount to 50 per company. It doesn't cost much to have more than one company. So no major changes to H1B Desi companies.

    3. Most of the big American companies will not offer new H1B with 180 days, since most of them would have had layoffs.

    4. Most IT companies will start spending a lot on lawyers. So they will be rich. There will be lot of audits.

    5. Companies will complete PERM and I140 before getting a guy onsite, only if people are really interested in coming to USA any longer.

    6. Need more clarity on where H1B outsourcing will be stopped...

    I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.


    whats your PD? Is your I-140 approved?

    You can get extensions even after the I-485 is filed. The only grey area is if your I-140 is not approved AND your LC PD is < 365 days.

    if I-140 is approved, you should get a 3 year extension (AC21 seems to imply you get an extension only if you cant apply for AOS, but USCIS has been interpreting that as if they cant grant you AOS due to PD not being current). A couple of my friends with non current PD and 485 pending for a while have got 3 year extensions

    I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.

    The job must qualify for EB2 first, with at least min prevailing wage!
    Which means BS+5 yrs of Progressive Exp or MS as min requirement.

    Need only one year tax return"

    I got RFE today asking company's 2001 return
    basically ability to payproffered wage that year
    wage were $53000 per year.
    Join the company actually in 2002

    There was a company change change with same dba xyz ... in year 2001,(means employer close the company and open another one with different name at same location)
    Same Owner and same business location so company file two taxes for company 1 and company 2

    Company 1 2001 tax return shows net income of $25,500
    Company 2 2001 tax returnshows net income of $28,300

    company bank account also shows over 100k in 2001


    I call my attorney already and did not hear back from him yet on this issue

    Can my attorney submit both tax return and claim one is the succsseror company(means employer took all acids, inventory and liability of old company of all the company) and presented to RFE office and
    is it very complecated case or simple case ?
    please help.

    When can you file WOM? It's a grey area. When the Name Check has been pending for more than 2 years like in my situation, then you definitely have "a case". However, I have heard that some people do it after "only" one year.
    Impossible to tell really when it's the "best" time to do it...

    Just a note( i am not trying to deter anybody or argue against your compilation) that by law all foreigners are required to carry their passport, how many of us follow that, on that note, I will not carry original with me at all. just my 0.02 cents.

    True, we do not carry passports every time we step out of our house (for example, when going to pick up Bud Lite from my neighboring grocery store). But I would think that passports, unlike the PR card, are not designed to be tucked into your wallet for carrying around. Also, for PR cards the always-carry-it-on-your-person law is explicitly stated (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fe17e6b0eb13d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=4f719c7755cb9010VgnVCM10000045f3d6a1 RCRD), whereas, stray cases notwithstanding (http://immigrationvoice.org/forum/showthread.php?t=16736), I am not aware of a similar law for passports (except maybe when you do not have your usual ID, such as DL).
